I am July 2007 485 filer. I currently work on H1B and my spouse works using EAD. I alongwith couple of friends am thinking of starting a business. Plans are that my spouse would be the owner of the business / incorporation.
Has anybody gone through the same process : incorporation, immigration issues, etc. Would you pl refer / recommend a good lawyer for this?

Yes, i765 is the EAD card. It will be issues eventhough your i140 is pending.
question: Can one work for the sponsoring company using the ead even if i140 is still pending?

You don't need an EAD to study full-time. Only if you are planning to work as as a graduate assistant while you study would you need an EAD. You are already in valid parolee status.

Yesterday I booked a visa appointment at the Mumbai consulate and no where on any of the forms did I specify that I was from Maharashtra but the appointment letter that comes out at the very end says in bold "State of Residence: Maharashtra" which is wrong.
I also canceled the appointment and re-booked it with the same outcome.
Has anybody had this happen to their case? Just trying to gauge how concerned should I get about this. Everything else on the forms looks correct but this one little thing.

its 2 weeks or 10 business days on external job website.
Recently applied second labor .thats what our company did
if i recall ,other than DOL website ,prettymuch everything was limited to 10 to 15 business days

Sir,
I got my green card on Feb'2008 and had to make emergency travel to my country Mexico to be with my family on August'2008. Now, I would like to come back after 10 months of stay in Mexico. The problem is that I do not have any permanent residence/car/Electricity bill to prove my permanent residency status except VOIP phone and paid my tax for the last 6 years promptly. Is it possible for me to make it to USA? or Should I wait for 2 more moths and file for Visa reentry permit in local embassy and come there if I get one?
Please advice me.

Greetings,
I have a pending 485 application under EB3 category through my wife's application. However, recently her employer applied for the EB3-EB2 change since she already qualifies for EB2. I understand that the priority date remains the same. In our case the priority date is Feb 05. I wanted to know what will be the process going forward. Currently the EB3-EB2 application is on the PERM labor state. Once that gets approved does it mean that our I485 will be adjudicated immediately since for EB2 the priority date has already gone past ours (feb 05)? Or we will need to then apply for another I-140?
If anyone knows the process of EB3 to EB2 transfer can he/she kindly post it?

You have to apply a new I-140 for the EB2 only then you can interfile with I-485.

Hi,
I'm trying to schedule my visa stamping date in aug /sept time frame in India. In delhi consulate when I click on Indian resident I see the available dates but when I click on Indian citizen residing in US, I see no availability. I'm not sure which option should I choose. I'm a student working on OPT in US. My OPT will expire on Aug 4th and so I will come to India. I'm not sure which of the two options I have to choose while scheduling an interview :
Resident of India/Bhutan
OR
Indian Citizen residing in United States.
I would really appreciate any help in this matter.

Now, I am going to file for my extension.
The question is that if my wife travels out of US before end of Feb, according to my lawyer we do not need to file foe her extension.
When she is to come back the lawyer says that she would get her H4 visa based on either my pending application or approved extension.
Is this possible, that without filing for her extension she can get her H4 in Delhi stamped, based on my extension application..??
Please share your thoughts.. I am perplexed..!!!

We recently assisted a client from Johannesburg, South Africa, regarding an H-1B specialty occupation visa. He was approved for an H-1B visa, but in order for our client to enter the United States, he must obtain an H-1B visa in his passport. Because the chances of visa issuance vary greatly depending on documentation and individual circumstances, we suggested that he go to the interview at the U.S. consulate very well prepared. We told him to take a certified copy of his entire H-1B package that was filed with the Immigration Service, along with his Form I-797 Approval Notice. We also suggested that he take original birth certificates, marriage certificate, and proof of financial support. He attended the interview this morning and his experience at the U.S. consulate in Johannesburg, South Africa was documented as follows.
“My wife, myself and our son had our interview at the U.S. Consulate here in Johannesburg this morning, at 9:00am. We duly arrived at 8:30am, had our relevant DS documents checked at the door, took a number, and waited for the “call.” At promptly 9:00am we were called to a booth, where our fingerprints were taken, the DS forms checked with the original I-797 form, and then told to go and sit down again. 10 minutes later, we went back to the booth, had our fingerprints taken again, and that was it.
