hi everyone
I m an MBA(major:general mba)student in a university in texas. I have an bachelors of engineeing (electrical & electronics)from india. I have found an desi employer who is ready to train me in SAP (FICO)functional and than place me on projects to diffeent companies. Since i m graduating in august 2008 ,At first i have to work for him on OPT and than in apil 2009 my employer will sponcer my h1 visa.
Now my question is....
1) can i work in SAP FICO functional , when i m on my opt?(opt means i have to work in a job directly related to my major field of study and i guess SAP is not related to my field major field of study)
2)will i have problems getting a h1b visa? (since General MBA and SAP are completely different fields )
Any comments or suggestions will be appreciated.

Hello All,
Following is my situation:
1) Recently got my L1 extension approval through company A which is valid through Aug, 2010.
2) I also have a Consular-H1B petition papers from same company A which is valid till Aug,
2011. But i don't have H1B visa stamp in my passport.
*My question is:
Is it possible to do H1B petition transfer from Company A to Company B without COS from L1 to H1?
OR
Should I first apply COS from L1->H1 through company A and then apply for H1B transfer from Company A to company B.
(and I believe for COS to happen i need to be still employed with company A.)
I am not planning to go India now but wanted to apply H1 transfer and work for the new company B in case of my layoff from present company A

Here are the minutes and action items ---
1. Congressman/woman are to be focussed but Sen. Kennedy 's office is the most important to focus on.
2. AI: Call Sen.Kennedy's office and try to seek an appointment to explain our issues and make presentation. Aim for last week in January.
3. AI: Find out stance of congressman/woman from MA on immigration committee. If any of them are in immigration sub committee. Identify the counties which these lawmakers represent. This will be a good way to filter out the ones we do not have to concentrate on.
4. AI: Make a list of groceries and places frequently visited by immigrants who could become potential IV members.
5. AI: Refine the presentatioin on IV resources section and provide the first draft to rest of team for feedback - 2 weeks.
6. AI: To enquire about the cost involved in posting ad in India New England paper/media.(Cost can be shared among local state chapter members)
7. AI: To enquire about posting ad (one frame) in Belmont theatre where Indian movies are shown. (Cost can be shared among local state chapter members)
8. AI: All members: Publicity of IV using posters and flyers available in IV resource section. Also publicise on sites like immigrationportal.com etc.
Though action items are assigned to certain members, if there's a feeling that you can pitch in please do so.

C# is a .NET language! C++, though, can either be .NET (managed) or unmanaged. You should clarify that with whatever job you are hoping to work on :)
The thing about .NET is that its main language is MSIL (Microsoft Intermediate Language). All of the .NET languages such as C#, VB, C++, etc. get squashed into MSIL.
I am utterly confused here. I see different jobs and stuff for .NET or c# or c++, etc. I thought they were all a part of .NET? We, July 2 filers, just got our receipts. So you are not that bad. After 90 days wait, you are entitled to ask for an investigation, but, as it appears, USCIS is not yet fully finished with all the receipts for July-Aug filers. They said that they will be done with it by month end. You may want to wait until then.

I am on H1, 7th year extension. My Labor just got approved. About to file 140. Now my project has apparently lost funding and the employer is offering me a temp job for 6 months till my 140 gets approved so I can use the approved 140 and move. But the catch is the new job requires a new H1 - different job description and pay. Will this affect my 140 filed with the old H1?
Let your lawyer confirm this: Get your I140 approval, if possible by using premium filing. File for a 3 year H1 extension. After extension, transfer H1 to new employer. Start GC process with new employer but maintaining your PD since your old employer aill not revoke your I140.

Right now Atlanta Processing Center processing May 2008 priority date for clean cases....for audited cases July 2007...
It's not true that all the cases will got to Atlanta Processing Center ...if any case that has been auidted will be moved to Atlanta Processing Center.

My I140 is approved and my I485/EAD/AP was applied last month and nothing is approved yet.
The company finances are not looking good , if I lose the job then what would happen to my GC application. I am hoping to get EAD before company pulls the wire on me though.
What would be my best options. Please reply ASAP

Hi All
Need some help here to understand what i should expect. Here is my case
Currently on EAD with my spouse as the primary applicant. I plan to travel outside US and return may be after a yr.
Assuming that i have satisfied the 180 days for this yr
1) what will happen if I dont spend the required time in the US next yr ?
2) Can i apply for AP from outside US next yr
3) Will i loose my EAD?
4) What is the process to re-apply if i will loose it?

I have a question. Our files are stuck in the Chicago local office (after our interview last year) and the only thing pending is the Namecheck, which has been pending for more than 180 days. Our PD is current. Is anyone in the same position?
It is frustrating because you do not get any LUDs when your files are in the local office and I have no indication whether the Chicago officeis processing cases with NC pending > 180 days. Anyone knows?
You should send a letter to local office and demand adjudication. Attach Feb 4th memo.

Hi,

Recently in dec i got my I-140 EB3 approved and my 485 is pending PD JAN 2005. I applied for EAD for my wife in july and she got it in sept. I am confused about what to do next? Sorry to hear about your situation. You are out of status the minuet you lost your job and the 180 days clock has already started ticking i.e. out of status for more then 180 days and still in the country may result in 5 yr entry ban.
I don't want to scare you but just sharing the law details.
Now you best course of action would be to get a job ASAP and get your H1 transferred. For this process immigration will ask for your last pay stub and if there is a big gap then they might reject your visa but again it is hard to say anything as it totally depends upon the officer.
Also, hire a good attorney if you can.
Staying in the US after losing a job on H1 is a gray area, especially when you have a valid i-94 hence getting a good attorney is very important.
Also, you might want to look at student visa or visitor visa to maintain your legal status.
