I heard under current USCIS procedures, USCIS scan an applicant for all existing I-140 approvals. You are then automatically assigned the earliest PD your are entitled to. (Multiple I140s with single I485).

I am not sure if they port PDs with different categories. Like One have EB3- PD2004 & EB2- PD2008 so EB2 will be ported to PD2004. I think they have have stpooed this & USCIS has started assigning multiple priority dates depends upon category.

Did everyone get receipt and transfer notice? I ask because I only got Transfer notice, and lawyer is not responding about whether he received a receipt notice(with July 2nd date ) also.

Transfer Notice has receipt date Sept. 14
Transfer Notice has notice date Sept. 17
Transfer Notice receipt starts with WAC

No other receipt for I485 or EAD.

if you file AOS (I-485) then only you will get EAD/AP benefits, but to file I-485 you need to stay in visa like H1B/H4. if you are H1B visa holder, you will eligible to file for it as prinicipal applicant but inorder for your spouse/dependents to qualify as dependent, she has to be in dependent visa (H4) at filing time, so F1 holder is considered as student not as dependent so they are not eligible to file.

Disclaimer: use it at your own risk, i'm not an immigration attroney, so please consult one for your situations as laws/procedures are changing often.

I have heard that it doesnt matter if your spouse is on F1 or H1. If one applicant files for I-485, his spouse will be included in the application never the less.

I had a non-traffic citation few years ago, which got dismissed and expunged. I do not have any documents relating to that incidence. I don't even recall the charges. I did background check with Sheriff's office which showed no records.
How should I present this on form I-485 (question about citation/arrest)?

AC21 Attorney Selection (Suggested by new employer Vs selected by you)

Agenda : Discuss Pros and Cons of each options

My views : Its better to use attorney from your new employer because its free, because s/he can better coordinate with the employer to get the offer letter describing same and similar job duties and also if you change to another job again you can change this attorney too..you have options and they are at no cost to you

The COBRA stimulus plan basically has two parts. In the first part, The COBRA stimulus plan will be able to step in and help struggling families trying to pay their COBRA benefits. People who are currently enrolled in the COBRA plan will get a 65% reduction in their premium costs. This will be a huge savings to many families struggling to keep their COBRA benefits.

Part 2: The Ability to Re-Enroll into COBRA

The second part of the COBRA stimulus plan will provide recently unemployed people the ability to re-enroll into the COBRA plan, even if they had denied coverage in the past. This will help a great amount of people who choose not to continue their health insurance through COBRA because they just could not afford it.

9 Key Details about the Cobra Stimulus Plan

1. Valid for people who were involuntarily terminated between September 1, 2008 and December 31, 2009

2. To be eligible annual income cannot exceed $125,000 for a single person and $250,000 for a couples

3. 65% of existing COBRA premiums will be subsidized by the U.S. Treasury Department

4. Subsidies will be available for up to 9 months

5. If you declined COBRA coverage after September 1, 2008 you will have the option to re-enroll into COBRA with the above subsides

6. Notices of the COBRA subsidies and re-enrollment information will be sent from the COBRA administrator (usually your previous employer)

7. Subsidies will be paid, via a refundable tax credit, directly to the COBRA administrators

8. Subsidies will terminate if the enrollee acquires a new health insurance plan through another employer or is eligible for Medicare

9. Subsidies will only apply to COBRA premiums paid after the effective date of February 17, 2009 and there will be no refund of premiums prior to this date

Thank you. We have just applied for 9th year H1 extension. so, requesting I-140 PP based on the current rules is not possible. I-140 is pending at TSC from Nov 2007.

Can anyone tell me if it is helpful to take info pass appointment and enquire about I-485 if I-140 is still pending. priority date is EB2 Dec 2003.

I think an approved i140 is recommended - but not required.
AC21 is basically to allow changing employers when 485 is pending
